Shiv Shanti Media provides email marketing services to businesses and individuals for promoting their products and services through email campaigns. Our services include the design and development of email templates, email list management, and distribution of email campaigns. By using our services, you agree to be bound by the terms and conditions outlined below.

 

 

2. Definitions:

 

  • "Service" refers to the email marketing services provided by Shiv Shanti Media.
  • "Client" refers to the individual or business utilizing the services of Shiv Shanti Media.
  • "Campaign" refers to a specific email marketing effort initiated by the Client through the Service.

 

 

3. Terms of Service:

 

  • Service Availability: Shiv Shanti Media will use commercially reasonable efforts to make the Service available 24 hours a day, 7 days a week, except for scheduled downtime for maintenance.

  • Campaign Content: The Client is solely responsible for the content of their Campaigns, including but not limited to the text, images, and any other materials included in the emails. Shiv Shanti Media does not claim ownership of any content submitted by the Client and does not pre-screen Campaign content. However, Shiv Shanti Media reserves the right to refuse to distribute any Campaigns that it deems to be inappropriate or in violation of these terms and conditions.

  • Email List Management: The Client is responsible for ensuring that all email addresses used in their Campaigns are obtained legally and are not harvested or purchased from third parties. The Client must comply with all applicable laws regarding email marketing, including but not limited to the CAN-SPAM Act.

  • Limitation of Liability: Shiv Shanti Media will not be liable for any damages or losses resulting from the use of the Service, including but not limited to any indirect, incidental, or consequential damages. The Client agrees to indemnify and hold harmless Shiv Shanti Media from any claims arising from the use of the Service.

  • Termination of Service: Shiv Shanti Media reserves the right to terminate the Service at any time and for any reason. The Client may terminate the Service at any time by providing written notice to Shiv Shanti Media.

  • Changes to Terms of Service: Shiv Shanti Media reserves the right to modify these terms and conditions at any time and without prior notice. The Client is responsible for regularly reviewing these terms and conditions.

  • Governing Law: These terms and conditions will be governed by and construed in accordance with the laws of the State of  Bihar, and the Client agrees to submit to the jurisdiction of the courts in  Bihar.
